What the Law Requires

Under UAE Federal Decree-Law No. 10 of 2025 and VARA's Compliance and Risk Management Rulebook:

  • Transaction monitoring must be continuous and exhaustive - not batch-processed or periodic
  • Suspicious transaction reports (STRs) must be submitted to the FIU immediately upon forming a suspicion - no delay permitted
  • Wire transfers and VA transactions above AED 3,500 require full originator/beneficiary data (Travel Rule)
  • All transactions must be screened against sanctions lists, PEP databases, and FATF-listed high-risk jurisdiction indicators
  • VARA January 2026 circular: enhanced monitoring required for dealings with parties from FATF grey/black-listed jurisdictions
  • Record retention: all monitoring records and STR logs - minimum 5 years

Transaction Monitoring: Two Layers

  • Layer 1 - Blockchain Analytics (On-Chain)
    Blockchain analytics tools assess the risk of wallet addresses and transaction flows using on-chain data. They identify whether funds have passed through:
    • Mixers and tumblers (obfuscation tools)
    • Darknet marketplace wallets
    • Sanctioned entities and OFAC/EU/UN-designated addresses
    • Stolen funds (exchange hacks, phishing)
    • High-risk exchanges and counterparties
    • Ransomware and cybercrime-linked wallets

  • Layer 2 - Behavioural Monitoring (Off-Chain)
    Rule-based and pattern-based monitoring of client behaviour and transaction patterns, independent of blockchain analytics. Detects:
    • Structuring: multiple transactions below the reporting threshold designed to avoid detection
    • Rapid round-trip transactions: funds in and out of the platform within a short window
    • Unusual velocity: sudden spike in transaction frequency or size inconsistent with client profile
    • Geographic anomalies: transactions from high-risk jurisdictions inconsistent with client's stated location
    • Layering patterns: complex transaction chains designed to obscure the origin of funds
    • Client profile mismatch: transaction activity inconsistent with stated purpose of account

What a VARA Inspection Looks For

VARA supervisory inspections assess effectiveness - whether monitoring is actually working, not just documented:
  • Live demonstration of blockchain analytics tool - can the team run a wallet risk query?
  • STR log - have suspicious transactions been identified and reported? How many? When?
  • Alert management - how are alerts generated, reviewed, escalated, and closed?
  • Calibration evidence - has the ruleset been tuned to your business model, not just deployed with default settings?
  • goAML access - is the MLRO registered and able to submit reports?
  • Staff competency - do operations staff understand what they're screening for?
A policy document describing transaction monitoring without operational evidence of a functioning system will fail a VARA inspection.
